Starving Mental Patients in U.S. Jails

Elliott Williams, 37, a mentally ill black man, died in a Tulsa, Oklahoma jail cell where he was kept for days without food or water. He was dead within five days of his incarceration.

Dog Justice Is Needed for America's Mentally Ill Citizens

In a horrific story out of Oklahoma, lawyers representing the estate of a prisoner who was found dead in the Tulsa Jail have sued the local sheriff’s office and the jail’s private health care provider. In a motion just filed in federal court, attorneys have asked a judge to release a video made of the man’s final two days, during which he allegedly languished in an isolation cell without food, water, or medical attention.

Elliott Earl Williams, 37, was pronounced dead in his cell at 11:21 a.m. Oct. 27, 2011, after allegedly going days without food and water.

This writer does not know if Williams died of an untreated head injury caused by running into a steel door or by dehydration and starvation. Another mentally ill man was arrested in October 2011 and emerged from incarceration in a body bag. Carlos Umana, a schizophrenic youth, starved to death after four months in a Utah jail. The Salt Lake City Tribune reports that a young prisoner who apparently suffered from serious mental illness died of starvation and dehydration after spending four months in the Salt Lake County Jail, much of them in solitary confinement. Carlos Umana, 20, weighed at 180 pounds when he entered the jail in October 2011; when he died on February 27, 2012 he weighed just 77 pounds (see photographs below). Tests showed that none of his prescribed psychiatric drugs were in his system at the time of his death.

As a teenager, Umana was diagnosed with schizophrenia and bipolar disorder. According to the Tribune, his mother, Tammy Martinez, said that Umana had stopped taking his medication in the fall. Then he started hearing voices and thinking people were poisoning him. "Umana was so concerned about people poisoning him," she said, "that he started preparing all his own food." Williams, Umana, and Larry all had documented mental health issues, but not every person who experiences a mental health crisis does. Some people snap under the strain of economic hardships and other life-changing stresses. Unfortunately, many people who break under pressure do not live through a lunacy arrest. Police should apprehend mentally challenged persons without resorting to deadly force. Consider the case of Dejuan Eaton. Fremont police shot Eaton as he allegedly chased his wife with a knife from their apartment while he was naked on November 4. See an excerpt of a news article about his death:

DEJUAN EATON, 37, had just received the news that his 18-year-old brother had accidentally shot himself in the head while handling a loaded firearm earlier that evening, according to his father, Alonzo Eaton. It was at that time that Dejuan Eaton, described as a loving, family man, was pushed to his limit.

"He had just lost his grandfather last Thursday, then to hear about his brother, it blew him over the edge," Alonzo Eaton said Tuesday. "I lost two sons within an hour of each other." Our condolences to the families of Umana and Williams. Both these deaths resulted in lawsuits that burden taxpayers for brutal treatment under the color of law. Luckily, the families found attorneys who filed their lawsuits, unlike the Neal family. We contracted with The Cochran Firm, which pretended to act as our wrongful death attorneys but held Larry's wrongful death case secretly inactive while the Tennessee statute of limitations passed in order to help the jail escape accountability. John Errol Ferguson Case: Daniel T.K. Hurley, U.S. District Judge, Grants Stay Of Execution

MIAMI -- A federal judge on Saturday granted a stay of execution for a convicted mass killer in Florida, who is mentally ill and was scheduled to be put to death on Tuesday, October 23, 2012.

U.S. District Judge Daniel T. K. Hurley granted the motion for a stay in the case of John Errol Ferguson, who was to be executed Tuesday after 34 years on Florida's death row ... Ferguson's attorneys maintain he is insane and that the Constitution prohibits the state from executing him.

"The issues raised merit full, reflective consideration," the court said.

Many people object to Ferguson being executed because of his schizophrenia. The National Lawyers Guild Disability Rights Committee issued an "Emergency Resolution in Opposition to the Execution of John Ferguson, a Mentally Ill Florida Death Row Inmate" that helps us understand the issue of mental illness and capital punishment. The Committee wrote in part:

THEREFORE BE IT RESOLVED THAT THE NATIONAL LAWYERS GUILD, MEETING AT ITS OCTOBER 2012 CONVENTION IN PASADENA, CALIFORNIA, condemns in the strongest terms the scheduled execution of John Errol Ferguson, a severely mentally ill African American man who has spent the last 34 years on death row, on the ground that it would be cruel and unusual punishment under the Eighth Amendment to the United States Constitution and would also violate international conventions on human rights to which the United States is a party, including the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment; and urges officials in the State of Florida to stop the scheduled execution and commute Mr. Ferguson’s death sentences to life imprisonment.

MENTAL ILLNESS: Federal Court Stays Texas Execution Because of Inadequate Hearing

Jonathan Green was scheduled for execution in Texas on October 10, but a federal judge issued a stay because the state did not afford him due process in examining his mental competency. UPDATE: The U.S. Court of Appeals overturned the stay of execution and Green was executed on Oct. 10 as planned. 

Don't Let This Become "Nazi America"

Before Nazi Germany started isolating and killing Jews, blacks, political dissidents, and homosexuals, the nation exterminated roughly 300,000 people who were labeled as being mentally ill. Then they killed the physically handicapped and elderly who were not useful to an "efficient nation." Don't become "Nazi America." When dogs are harmed, there is a huge outcry. But when mentally ill people are imprisoned rather than treated in hospitals or community care programs, isolated in solitary confinement torture, subjected to police brutality, or left to fend for themselves and wind up homeless and destitute, too few voices rise in protest. Disregard for human life spreads quickly. Stop crimes against humanity before this becomes "Nazi America."

Don't Become Nazi America

During this week in 2008, I stopped driving. My brother had been kidnapped and murdered by police. I was being followed by up to four vehicles everywhere I went, including government vehicles. My mother and I had sued The Cochran Firm, not knowing it was some pseudo-government agency in place to defraud blacks in Johnnie Cochran's name. We sued the lawyers for pretending to represent us in a wrongful death civil action after Memphis Police secretly arrested and killed my mentally, physically disabled brother, Larry Neal. Since the lawyers tricked us to save the jail where Larry was killed, we sued them for fraud. I started being followed right after our lawsuit was served in January 2008. On September 27 around 9:30 p.m., they trailed my grandson and me from Kroger grocery store for six miles to the neighborhood Chevron station. I pulled in there, thinking they would go away like they normally did when I reached a business with lots of people. But this time, they followed me into the station parking lot and parked. I called 911 from inside the service station, because I had already stopped carrying a cell phone. I discovered months before that night that if I carried a cell phone, I could not lose them. We waited for emergency responders for over an hour, but police never came. My relatives had to come in two cars to rescue us. After I stopped driving, stalkers were moved into homes nearby ours in Stone Mountain, Georgia. I didn't hear the term "gangstalking" for another year. I stayed home after the terrorism and advocate online for acute mental patients to be treated justly and humanely. We planned a lawsuit against conspirators against justice for Larry Neal's murder. People who are "different" are in danger in Memphis and elsewhere in the USA. The mentally ill, like my brother was, are killed regularly. People in the GLBT community are also mistreated. Duanna Johnson, a transgender woman, was beaten and sprayed with pepper spray by a Memphis policeman while another officer held her still for the beating in February 2008, because she refused to respond to derogatory commands. No police officers in the intake area protested the brutality. She contracted with attorneys to sue after the video evidencing her brutality went viral, but she was killed several months before the end of Tennessee's statute of limitations, and no lawsuit was filed in her case. Her murder remains unsolved. One attorney who worked in the office with Johnson's lawyers was Julian Bolton, the former managing partner of The Cochran Firm and a Shelby County Commissioner. A few weeks after Duanna died, the U.S. vice president and former attorney general were indicted in Willacy County, Texas for using their government positions to withhold investigations and prosecution in jail deaths and abuse cases. MPD continues to kill the mentally ill. The most recent of nine people killed by Memphis police so far in 2012 was Christian Freeman, 19, a paranoid schizophrenic. He was shot to death on June 12 about 1:40a.m. behind FedEx Forum near Fourth and Beale. Police claim Freeman charged at two officers with a knife and they shot him to death. That was Freeman's second encounter with police. He spent a month in a mental health ward after allegedly yelling and making obscene gestures at police officers in April 2012. Freeman's uncle in Texas, Todd Jones, said police should have tried to incapacitate and restrain Freeman rather than shooting him. Memphis Crisis Intervention Team (CIT) is used as a model for intervention services regarding arrests of the mentally ill, but Memphis police do not use it. Very rarely does a week go by without police killing a mentally ill person somewhere in the United States. Houston police killed a mentally ill double amputee at his care home last week. Police were called to the East End personal care home around 2a.m. after Claunch became agitated because his caretaker refused to give him a soda and a cigarette. Matthew Marin, a five-yr HPD veteran, shot and killed Brian Claunch. Marin, who had fatally shot another suspect in 2009, felt the double amputee who was confined to a wheelchair threatened his and his partner's life. Another mentally ill person was killed by police before I could finish editing this article. New York Police Department gets credit for this death. The mother of Mohamed Bah (left) called 911 on September 26, 2012, after the 27-year-old cab driver and student refused to open the door to his Harlem apartment. Police came, and apparently Bah tried to attack the police officers with a knife. He was shot once in the chest. A tranquilizer gun might work for cases like this. Charging animals are shot with tranquilizers, but sick human beings get live ammo. See a poem I wrote and published online that is probably America's most censored poetry, called "DOG JUSTICE." It was written one night as I watched the news and saw federal agents and police officers comb Michael Vick's ranch regarding dog abuse while the same justice system was working to keep my brother's death covered up. Thousands of people, including this writer, were outraged about the dogs' deaths, but excuse me for thinking people's deaths should count as much or more. NYPD killed another man who was experiencing an emotional crisis and threatening suicide a few weeks before shooting Mohamed Bah in Harlem:  Walwyn "Smiley" Jackson. On September 7, 26-year-old Jackson was shot by police in Queens. His family had called 911 when they found him holding a kitchen knife to his own throat. Jackson was distraught at being unemployed and unable to provide for his 2-week-old son, Landon. Jackson's grandmother, Gloria Cameron, said in an interview:

"We called 911 because we wanted an ambulance to come to take him to the hospital. He was no threat or harm to anyone but himself. When [the police] came to the door, I didn't want to let them in. They told us to get out of the way and stay downstairs. One of them went for his gun as they went upstairs. I tried to tell them he's sick. I started to cry and then I heard the shot. Before Nazi Germany began killing minorities, around 350,000 people who were labeled as mentally ill were first to be isolated and terminated, even children as young as age 2, whether they were Aryan or Jewish. There are currently 1.25 million mentally ill inmates in America. When mentally ill people are killed in public like Kelly Thomas, who was beaten to death by Fullerton, California police officers, those deaths are impossible to cover-up, but cops try. They demand the cameras from people who film their brutality. But people who are arrested first, like Larry Neal was, are not surrounded by people carrying cell phone cameras who will load the videos online. Therefore, Memphis Shelby County Jail returned Larry's dead body and refuse to say how they killed him. Officials at the United States Department of Justice (USDOJ), which was in overview of the jail after a lawsuit to prevent more brutality to inmates, helped the "correctional" facility cover-up Larry's murder, and I am gangstalked and censored to prevent Americans from knowing about the mass arrest and extermination of the country's mentally ill citizens. Nazi Germany had problems hiding the extermination of its mentally ill citizens, also. Nazi officers discussed the problem, and their communication around this issue was saved for posterity. God looses in heaven what we loose on earth, and He binds in heaven what we bind on earth. Silence regarding the victimization of America's mentally ill has loosed a spirit of Nazism in this country. Once the sanctity of human life was disregarded by the government in its exterminations of the mentally ill, Germans began to kill everyone who was handicapped or elderly and therefore not useful to an "efficient nation." Next, Germany exterminated Jews, homosexuals, blacks, and political dissidents in its Final Solution, and a culture of fear and government suppression engulfed the nation for a period of 50 years until the Iron Curtain fell in 1989. Nazism, the spirit of Antichrist, was not only responsible for millions of deaths but also the virtual enslavement of the entire nation, which continued for decades. Disregard for human rights in Nazi Germany began with the mass arrest and extermination of the mentally ill just as it did in America, where 1.25 million mentally ill people are prisoners, and many are killed under the color of law on our streets, behind bars, and even in care homes. Mentally challenged children are also brutalized. I love America and do not want to see her turn Nazi. If you feel that way, also, please share this article and join the struggle to reinstate the constitutional protections for human rights that Congress, the White House, and our courts have eliminated. No one escapes oppression by being silent about encroaching Nazism. That did not work for the people in Germany, and it will not work in the United States or anyplace. Houston Police v. Schizophrenic Amputee

Mentally ill people from working class or poor families are killed by police officers throughout the nation at an alarming rate. Usually one or two such deaths are reported in mainstream media each week, but many more deaths happen behind bars among approximately 1.25 million mentally ill prisoners in America. Those killings may be suppressed in news reports like Larry Neal's murder was. He was both physically and mentally disabled, like the subject of today's tragic report was.

(CNN) -- A Houston police officer shot and killed a schizophrenic, wheelchair-bound double amputee threatening people with a pen at a group home for the mentally ill after authorities said the man advanced on the officer's partner.

Another news report: Matthew Marin, 5-yr HPD veteran, shot and killed Brian Claunch at a personal care home in Houston. Marin, who also fatally shot another suspect in 2009, felt a double amputee confined to a wheelchair threatened his and his partner's life. Claunch was armed  according to police reports [with a silver writing pen]. Police were called to the East End personal care home around 2 a.m. after Claunch became agitated because his caretaker refused to give him a soda and a cigarette.

Claunch's family is lucky that their relative was killed before witnesses, leaving no opportunity for a cover-up. Therefore, the system need not subject his survivors to censorship, burglaries, and gangstalking. Hopefully, there will be no Cochran Firm-type lawyer fraud to prevent a lawsuit from being filed if survivors choose to do so, and no payoffs to government officials and the media, etc. to keep the case hidden. The schizophrenic amputee's family already knows the circumstances of the victim's death. Thus, they will not have to file Freedom of Information Act requests that authorities ignore. Deaths of mentally ill Americans that happen in the public are difficult to contain, like Kelly Thomas's fatal beating by Fullerton, CA police officers.

Imprisoned Two Years without Trial

DOG JUSTICE FOR THE MENTALLY ILL

I have an adopted brother who is mentally retarded FAS, with an I.Q. of 62. Travis was falsely accused in federal court of aggravated sexual abuse of a child. Travis has no blood relatives. My mother raised him. After Travis came of age, he stayed with my parents and helped with all children, not ever hurting anyone. After arrest, he went all over the United States to be evaluated, only to be given the same diagnoses that the psychologist had given my mother: Travis is of no danger to anyone. He just returned from Butner, North Carolina. Psychiatrists recommended for Travis to be released from custody. Authorities would release him to someone who has no children, but everyone has children. Travis has been held for two years and one month.

My mother passed away on August 12, 2012. They didn't even allow Travis out for the funeral. It is a sad situation. We are Native Americans, and the system is prejudice against us. We have no money to help Travis, and he has no money.

The entire country is upset about provisions in the National Defense Authorization Act (NDAA) that give the White House the ability to intern people indefinitely under military arrest without criminal charges or any opportunity for defense. On September 12, 2012, a federal court issued a permanent injunction against indefinite detention without due process. However, this is how many of America's mentally challenged people live. It is unacceptable to warehouse the nation's most vulnerable citizens in jails and prisons, but 1.25 million mentally challenged people awoke behind bars today. In fact, over 60% of inmates in cruel solitary confinement are mentally ill. They should be in hospitals or in community care programs, depending on their offenses and functionality. Travis and over a million other mentally challenged Americans are behind bars for PRISON PROFITS. Their human and civil rights are continually trampled. My own mentally ill brother was killed while under secret arrest for nearly three weeks in Memphis Shelby County Jail http://WrongfulDeathOfLarryNeal.com . Our family is denied any records or investigation. That proves mentally ill people, particularly minorities, are considered by their government to deserve no protection, even for the right to life.

I’ll never forget the day I got the phone call: My brother Peter Price, who suffered brain trauma from a bicycle accident, had swallowed 5 fish hooks and 22 AA batteries, in a desperate attempt to escape the rehabilitation center where he was abused. I was devastated. Not long after Peter had been placed in the Florida Institute for Neurologic Rehabilitation (FINR), he had begun complaining that staff would frequently hold him down and punch him in the face and groin. He said he was locked in a tiny cabin for weeks.
 
The conditions Peter described were horrifying, and I tried to get him moved quickly. But he was in so much distress he couldn’t wait. He risked his life because he saw no other way out.


Today, Peter is doing well at a different rehabilitation center where he is tended to by a caring staff. But I was haunted when I learned that dozens of defenseless patients at FINR continued to face abuse.

That’s why I started a petition calling on the Department of Health to investigate and shut down Florida Institute for Neurologic Rehabilitation in light of hundreds of abuse allegations that have surfaced: http://goo.gl/XqVBP
 
You can imagine how I felt when I read a Bloomberg News article last week that highlighted the stories of those abused: Danny Silva, an autistic patient assaulted by staff on camera; Michael Lieux, a Marine killed after staff pinned him down until he suffocated; and Reginald Hicks, a tube-fed patient who died after staff fed him food that lodged in his lungs.
 

Those stories are just the tip of the iceberg -- there have been more than 477 allegations of abuse at FINR since 2005. A congressional investigation found that staff prolonged the stays of patients to boost profits. Yet, FINR continues to operate and even accept new patients.
 

State agencies have swept the issue under the rug, but if thousands of  people sign my petition calling for a federal investigation, the Department of Health won’t be able to ignore us.
 

My brother is proud I’m speaking up for vulnerable brain injured patients like him – no one should have to go through the abuse that he did ever again.

I'm sorry your brain damaged brother suffered abuse and others are still being abused in the facility where he was warehoused. Mentally ill people and everyone with brain injuries are at risk for losing all human and civil rights. Do not forget that Florida is the state where a brain damaged woman was starved to death in March 2005. I am very surprised they let you tell about your brother, Jessica. Are you being gangstalked and censored like I am yet? The responsibility to protect Americans' civil rights falls on the USDOJ, which helps cover up my brother's murder. Nevertheless, I am forwarding your complaint to the USDOJ and others.
