Black Women Barred from "Standing Their Ground"

~ Black Women Are Prosecuted for Self-Defense in the USA ~

Brenda Anderson, a Black lesbian at the time, defended herself against attackers in Texas after she left the check cashers' and went to a movie. She observed a man watching her as she pulled a wad of money out of her pocket at the movie theater's concession stand. Three men followed Brenda as she walked from the theater. When she reached a dark, lonely street, one of them pulled out a gun. She shot two of the men, paralyzing one of them. Brenda was immediately arrested. Her trial centered on her homosexuality rather than her right to self-defense. She was accused of "hating men," although the men were repeat offenders. I read news published by the about Beaulah Montgomery, a White woman who fatally shot two of her seven attackers, and I thought about Brenda. The story about Beaulah was fabricated, but Brenda's story is true. Black women are not allowed to "stand our ground." The world learned that during the prosecution of Marissa Alexander, a Florida woman who was initially sentenced to 20 years imprisonment for firing a warning shot to stop her ex-husband from beating her just days after she had given birth. Brenda Anderson was tortured in solitary confinement for years. As a prisoner, she was even made to undergo surgery on her abdomen without anesthesia. 

Many people are concerned about the tendency that America has to disregard justice in order to incarcerate more people for prison profits and to cover-up abuses of power that are most common regarding people of color and the mentally ill of all races. Prison investors tend to favor arresting people in either category, with or without guilt. But these facts are treated like secrets. As I tried to post this story at Google+, hackers interfered. I then waited through a slowdown virus to post this news at Facebook. The government should prevent hackers from taking over computers belonging to human rights activists, especially if the hackers work for the government. But censorship regarding discrimination and the prison industrial complex is treated like a lawful activity.

Presidential candidate Bernie Sanders is against the Trans-Pacific Partnership Agreement (TPP), which may be used to stop Americans' freedom of press online. That would limit dissemination of information about the prison industrial complex and other human rights issues. More importantly, Bernie Sanders announced a war against private prisons and jails and has entered a bill in Congress that would end federal contracts with private prison comapnies. Without private prison profiteering, Brenda Anderson and many other women might not have suffered for decades behind bars. Eliminating private prison profiteering, like Sanders plans, is the only way to end mass incarceration in the USA, and exposing injustice such as Anderson experienced is the only way to elicit support for its eradication. Help stop TPP and private prison profiteering in one blow - support Bernie Sanders.

Innocent Child with Down Syndrome and Parents Assaulted by Police


"After Juan Ortiz was placed in handcuffs and thrown in the back of the cruiser, police finally realized that they had the wrong guy. However, their reaction was hardly contrite. After assaulting an innocent young boy with Down syndrome and throwing his mother to the ground, Kazimer tells the parents, 'You’re lucky we didn’t shoot him.'”

Cop Murders: Blame the System


Some blame the president, New York's mayor, the protesters, and even the black men and boys who were murdered by the police and vigilantes. We should blame the broken mental health system for Ismaaiyl Brinsley shooting his girlfriend, two police officers, then himself. Condolences to all grieving families.

Brinsley had been arrested numerous times and was recognized to have mental illness. Tragedies can be avoided when troubled inmates are released only under programs that include mental health treatment. We
 can help New York State prisoners with mental illness get better discharge plans by supporting S7818/ A10071 "The Prisoners Mental Health Discharge and Planning Bill.”

The bill passed the New York State Assembly and Senate, but Gov. Cuomo has to sign it for it to become law. The bill makes sure prisoners with mental illness who are being released are given a discharge plan, an appointment with a community program, and enough medications to last until the appointment. It also adds parole officials to the list of people who can refer someone with a mental illness to a hospital for evaluation. This will help reduce reincarceration, says mental health expert, Dj Jaffe, director of the Mental Illness Policy Organization.


Ismaaiyl Brinsley's face is not the one that should be applied to the nation's righteous protests against police violence. Hundreds of dead men and boys and thousands of nonviolent protesters of all races who stand together and say "All lives matter" should remain the focus of the movement for greater police accountability. 


More than half the victims of police violence are mentally ill people like my brother Larry Neal was when he was secretly arrested for 18 days and murdered while in Shelby County Jail in Memphis, Tennessee (see the website below). Even as we mourn the loss of police officers and hundreds of citizens killed in police-related incidents, Milwaukee alerted the National Guard prior to releasing the indictment decision for another mentally ill man who was slain by police. Clearly, unjustifiable deadly force by police is a major problem in the United States that must be exposed and opposed for the sake of the lives that should not have been taken and the continued peace in our society. The appropriate response is not cop killings such as those done by Ismaaiyl Brinsley, a mentally ill man. And blaming politicians and community organizers for protests against the lack of police accountability will not resolve the problem. This is the time for our officials over government to take bold, decisive action to protect the lives of everyone who is at risk because of overzealous policing. Suggestions are:

1) All police officers should undergo psychological evaluations, drug testing, and thorough background checks before hiring. Maintain a database on all police officers who were terminated because of inappropriate conduct. Police officers who have been fired because of substantiated complaints by citizens citing harassment and overuse of force should be ineligible for rehire by any other police department or in any capacity that requires the personnel to carry a firearm.

2) Conduct unscheduled drug testing for police departments periodically, and test every officer immediately after his/her involvement in violent incidents. Steroids cause brain damage and aggression, and should be included in the drug tests for police officers.

3) Hold police officers accountable to the same standards that prosecutors would apply to other citizens when they become criminal suspects. Police officers who become criminal defendants should pay for their legal defense using their own personal resources or use public defenders. In no case should police defendants' legal defense fund include taxpayers' funds beyond the monies already appropriated to make public defenders available to defendants who cannot afford an attorney.

4) The U.S. Congress passed a bill requiring an accurate count of all people in America who are killed by police and who die in custody, regardless of the cause of death. The data reported will include the name, age, race, and gender of each victim, and information about the death. Assistance to the Incarcerated Mentally Ill (AIMI) holds that an additional category must be whether or not the victim had a documented diagnosis of mental illness and/or history of substance abuse. It has been stated that the database will be used to assess information on race-based killings. The government not only has the responsibility to protect Americans of diverse races but also a responsibility to protect Americans with mental disabilities, which has been largely overlooked. Therefore, the bill for data collection from police departments should be amended to add an entry for mental illness before the president signs it into law.

5) To reduce the violence to and by mentally ill Americans, the nation should immediately fund assisted outpatient treatment (AOT) programs for all mentally ill inmates or hospital patients before their releases. The U.S. Congress should pass H.R.3717 "Helping Family in Mental Health Crisis Act," which has a pilot program for AOT programs as well as other provisions that would help repair America's broken mental health system.

6) When police kill, should they judge themselves? Gov. Scott Walker (Wisconsin) answered with a resounding "no," signing into law a bill that requires outside investigation when people die in police custody — the first of its kind in the nation. This should become a federal law. (See a link to the news story from Wisconsin below).

In addition to the black boys and men, police also killed numerous black women. Some of their photographs are shown below. 

Immediate measures must be enacted to prevent the United States of America from falling into anarchy. Citizens cannot be expected to tolerate the continued police killings of unarmed people who are black and brown or whites who lack wealth, and the lives of the nations' most vulnerable people (the homeless and the mentally ill) must be protected. Unless the government's aim is Martial Law, changes must be made with haste to ensure that all deaths are met with due process of law - not by government cover-ups, excuses, and ignoring laws against murder if prosecution against police and corrections officers is warranted. No amount of criticism by the police union against protesters, officials, and community organizers will suffice to repair the growing breach between police departments and the citizenry they are paid by taxpayers to protect. 


DEATHS IN CUSTODY MUST BE REPORTED, INDEPENDENTLY INVESTIGATED,
AND PROSECUTED IF WARRANTED



America must fully honor the U.S. Constitution and the International Declaration of Human Rights for the sake of its domestic security. On Sunday, December 21, 2014, "Human Rights Demand" on Blogtalkradio featured an interview with Windy Hempstead, whose brother Harold Hempstead reported the murder of Darren Rainey. Rainey was killed in Dade Correctional Institution in Florida in 2012 (see the link to the show below). Two years later, Rainey's murder by scalding in a small shower had not been investigated, and the corrections officers responsible had not been disciplined in any way. The Hempsteads then took the story about Rainey to the Miami Herald, which reported the news, unlike mainstream media companies I contacted about Larry Neal's murder, which was also ignored by all government authorities. 

Even today, almost three years after Rainey's torturous death, the medical examiner has not filed an autopsy report, and nobody has been charged with Rainey's killing. The jail and USDOJ refuse to release information about Larry Neal's murder eleven years later. Unrequitted murders say "Black lives don't matter," and the public disagrees, as it is their moral duty to do so.

If the U.S. Government is as inept at protecting the human and civil rights of minorities and Americans with mental illness as it appears to be, surely we need help from other countries and the United Nations. Demonstrations against unrequited police violence were held in diverse countries throughout the world when officers involved in the wrongful deaths of Eric Garner and Michael Brown were not indicted. Brown's family traveled to Geneva to the United Nations and cried out for assistance making the United States honor its obligation to uphold equal justice for all. U.S. protesters also spoke at the United Nations to say "Hands Up, Don't Shoot" and "I Can't Breathe." 

AIMI plans an action in International Court in 2015 to protect the rights of Americans with mental illness. AIMI will bundle up to 100 cases detailing neglect, police brutality, systemic torture in custody (including solitary confinement), and unrequited deaths of mental patients and drug/alcohol addicts as well as their victims. The cases will be represented by an international human rights lawyer in a civil action for recovery of damages for the victims or their survivors. AIMI will also present a list of recommended changes that we hope the United Nations will mandate for its member state, the USA, to prevent more loss of innocent lives and avoid disruption of peace in this country where continued police murders and deaths in custody threaten the entire social structure. The face of Ismaaiyl Brinsley is not the correct icon for the People's opposition to police violence. Protesters condemn his actions. Brinsley was merely another mentally ill man who lacked the psychiatric treatment that he needed and deserved. In fact, his mental disability leads to the deaths of hundreds of Americans' deaths annually, killed on our streets and in custody. The struggle for police accountability is better depicted by the posters in this blog showing men, women, and children who were killed and thousands of nonviolent protesters in the video and photographs below.

AIMI members hope that all government officials follow Gov. Walker's lead and apply corrective measures to overuse of force incidents and deaths in custody that threaten peace in our society. 

Problems are caused by the system which refuses to police the police and acknowledge that all lives matter, not by protesters who cannot breathe in such a system.

Ron Thomas Pokes Fun at Michael Brown's Death


Ron Thomas, the father of police victim Kelly Thomas, is making fun of the murder of Michael Brown on Facebook. I am sure Ron, a former police officer, showed the same lack of human compassion to his dead son, which is probably why Kelly was homeless and left to be murdered as a "useless eater." People who disregard the right to life for minorities generally feel that handicapped people don't deserve to breathe, either. Read the history of Nazi Germany, which started its genocide by killing over 300,000 people with mental and physical disabilities BEFORE starting on Jews and Blacks. The same hatred that killed Kelly Thomas killed Michael Brown. Thank you, La Mesha Irizarry for pointing out Ron Thomas's very insensitive post about Brown wherein he actually made fun of Brown's murder. Thomas showed the video from the store (said to be Mike Brown stealing cigars) and wrote: 

"And heres little "Mikey Brown" as he is leaving the liquor store with his "5 finger discounted" smokes. All 290 pounds of him!"

Upon receiving criticism for his post, Ron Thomas then wrote:

"Because I re-post a publicly released video showing a 290 pound 18 year old robing and assaulting the clerk, I'm a racist.
Good luck with [that] one.
To make it clear, I DON'T LIKE BAD GUYS!
I don't care what the color of their skin is.
I didn't make any comment about the shooting, or the cop that shot him, and yet you can clearly think that I am a racist.
My whole point was (and you are not the only one too blind to see it) that he was not the little angel that so many are trying to make him out to be.
I never said that he should have been shot or anything like that.
You like so many others knew right away that Brown was "Murdered" by a white racist cop.
Share your proof and facts with me so I can also get on the band wagon and burn cars, rob stores, block freeways and major streets without even knowing why I am doing it.
All that I want is some proof that Brown was Murdered by a white racist cop as you think.
Can you give me that?

Neither Michael Brown nor any other unarmed black teenager must prove to be a "little angel" to have a right to life, Ron Thomas. Insinuating that Officer Wilson had a right to kill Brown because of stolen cigars is ridiculous. Whereas you want sympathy for your son's death by police, you imply that police had every right to kill Brown, who was also unarmed and reportedly posed no threat to Wilson. It leads one to wonder how safe people's sons were while you were a police officer.

Luckily, there was a video of Kelly Thomas being beaten to death, but there was no live video of Michael Brown being shot to death. However, many witnesses came forward to assert that Brown was surrendered when he was killed, just as your son was as he begged for his life. It should not be hard for someone who watched his own son die at the hands of six merciless police officers to believe the same thing could have happened to Michael Brown. I remain a supporter of justice for Kelly Thomas, especially now that I understand why he was homeless.

Dog Justice: 23-year sentence for shooting police dog

A black youth was sentenced to 23 years for shooting a former police DOG. Cops who beat Kelly Thomas to death didn't serve a day. Cops who murdered Larry Neal under secret arrest were never even investigated. Virtually every murder and abuse of the mentally ill in this DogJustice blog was done by cops and corrections officers who were not prosecuted. Too bad black people and the mentally ill don't have Dog Justice, isn't it?

I was so impressed with America's zeal to enforce justice for pit bulls that I penned this poem, wishing that certain people counted as much as dogs in America with their right to life, liberty, and pursuit of happiness protected like canine citizens:

DOG JUSTICE

Too bad you weren't a dog, my brother
In my heart, I cried
Many more people would care about you
And wonder why you died

You had no spots or floppy ears
You never fetched a ball
Instead, you were a human being
But poor, black, and flawed

You died in jail for mental illness
I know down in my heart
Your death would be investigated
If only you could bark

Dog deaths get swift justice
Their abusers are sent to jail
Poor Mama would have closure now
If you'd had a wagging tail

But you were made in God's image
And some day, I have no doubt

Indefinite Detention Without Crimes

How do you feel about people in the USA being detained based on police suppositions that they have a high likelihood for future crimes? INDEFINITE DETENTION WITHOUT CRIMES, CRIMINAL CHARGES, OR DEFENSE IN ARIZONA ~It all begins with the mentally ill. Arizona is the latest to begin using pre-crime models to supposedly thwart attacks by those who are “near the breaking point.”

The video embedded below highlights how mental health police units look to harvest everything from medical records to gun purchases to online posts. Citing the crimes of Jared Loughner and Elliot Rodger, these units are being given the green light with new legislation to involuntarily detain those who are flagged. As long as police use this power only to detain people in mental distress, it has the potential to benefit persons experiencing mental health crises as well as their families and communities. People who have mental illnesses are usually denied treatment. Stringent restrictions ordinarily prevent families from involuntarily committing their members who need psychiatric treatment. In fact, mental hospitals have closed or downsized throughout the country to the point that inpatient treatment is nearly impossible even for voluntary commitments. Since Medicaid insurance was withdrawn for psychiatric inpatients in the 1970s, taxpayers have paid billions of dollars each year to warehouse mentally challenged people in the nation's jails and prisons rather than using much less money to improve community care and make hospitalization available for short-term and long-term psychiatric treatment.

Prison profiteering is spreading throughout America like an airborne disease. Care must be given to avoid civil and human rights abuses under this new law. Psychological research studies have proved repeatedly that police perceive black youths as being perspective criminals. In the absence of stringent oversight, police powers to detain people who are not suspected of any crime whatsoever could be misused against minority populations and poor people.

According to the news video above, people who are detained under this law in Arizona are taken for psychological evaluations and not to jails or prisons where 1.25 million mentally ill Americans wrongly endure incarceration as criminals. Bridgewater State Hospital Investigation


A death in restraints after ‘standard procedure’ at
Bridgewater State Hospital psychiatric prison

Joshua Messier was having a schizophrenic attack, then died as Bridgewater state prison guards subdued him. The medical examiner called it homicide, then changed her mind. No one has been prosecuted, or even reprimanded, for the death of a young man in state care.


In a sequence caught on surveillance video, two of the guards had pushed down hard on Messier’s back as he sat in handcuffs and leg irons on the bed, forcing his chest toward his knees. The tactic, sometimes called “suitcasing,” is banned in Massachusetts prisons because it can cause suffocation, especially for those like Joshua Messier, who had grown overweight from taking antipsychotic medications. Today, Bridgewater is back in the news. BOSTON (AP) - A nonprofit watchdog group has opened an investigation into the treatment of inmates at the Bridgewater State Hospital psychiatric prison.

The state Department of Correction confirmed Wednesday that lawyers from the Disability Law Center arrived at the medium-security prison Tuesday to meet with administrators, gather records and talk to patients.

The investigation comes in the wake of reports that guards and clinicians had illegally put mentally ill inmates and patients into physical restraints and isolation cells, and soon after two high-profile cases.

In one case, the parents of a man who died while being restrained at the facility in 2009 settled a lawsuit for $3million.
In another, the mother of a man being held at the hospital filed a lawsuit saying he had been restrained and isolated for unreasonably long periods of time.

First, they came for Larry Neal

FIRST, they came for Larry Neal http://WrongfulDeathOfLarryNeal.com and I said nothing, because I am not African American . . . Then they came for Kelly Thomas, Ethan Saylor, Brian Claunch and thousands more. Over 50% of police violence victims are mentally ill people of all races.









Brian Claunch was an unarmed, wheelchair-bound, schizophrenic double-amputee who was shot and killed by police in his Houston, Texas care home because he asked for a cigarette and soda.

Few African Americans said anything about the secret arrest and murder of Larry Neal, either. They were apparently told not to report news about Larry, who was murdered after 18 days of secret arrest in Memphis Shelby County Jail, in a "chocolate city" headed by a black mayor and many blacks on the County Commission - mostly NAACP members. That is how ridiculous it is for Americans to make race our main focus. Oppressors come in ALL COLORS. Google "The Cochran Firm Fraud."

We the People have relatives, friends and neighbors who are at risk for incarceration and death-by-police because of the deprivation of psychiatric treatment. Our communities' safety is continually compromised because of untreated mental illness, which is deliberately left untreated until sick citizens "prove" to be a danger to self and others by committing some crime worthy of imprisonment. Approximately 1.25 million mentally ill people are presently imprisoned and comprise at least 60% of inmates in solitary confinement torture. Every year, hundreds are killed by police officers in avoidable tragedies, even when they present no threat to police or anyone else. 



The lives of mentally ill Americans are marginalized. This travesty of justice will continue for as long as families like the Neals are terrorized and censored to prevent disclosure while the People of America look the other way. Imprisonment for prison profits and avoidable deaths happen to African Americans, Caucasians, Asians, Latinos, and Native Americans. The only brain damaged people who may be exempt are the very wealthy - people can afford psychiatrists, private hospitals, and caregivers. Oppression of psychiatric patients is historic and universal, but nowhere is it more evident than in the United States of America, where the common, treatable health condition was criminalized and treatment is withheld in order to generate prison profits. Even veterans who transition from the battlefield become prisoners of war in America due to untreated post traumatic stress disorder. 

Exposure of America's mental health crisis is increasing, even in mainstream media. Mary Neal, director of "Assistance to the Incarcerated Mentally Ill," continues to find new avenues to expose discrimination against millions of Americans of all races who are subject to extreme negligence that leads to homelessness, prison and death: wrongful executions, police brutality (including deaths), and torturous prison sentences, many without trials.

WE DEMAND (1) accountability for all deaths, including accurate record keeping to document deaths and catastrophic injuries caused by police to mentally ill and brain damaged Americans; (2) easier access to involuntary commitment; (3) specially trained police officers to answer emergency calls involving people with brain issues; (4) a significant increase in psychiatric hospital beds; and (5) assisted outpatient treatment (AOT) programs mandating continuous psychiatric care and subsistence assistance to prevent re-hospitalization and recidivism for all acute mental patients exiting psychiatric hospitals and correctional institutions.

WHERE WOULD THE MONEY COME FROM FOR THESE FIVE CHANGES? Over one-half of America's prisoners are mentally ill people, many of whom would not have been arrested if they had not been deprived of care. The prison industrial complex is paid roughly $25 billion per year for their cruel incarceration (according to the 2008 PEW estimate of America's $50 billion per year prison expenditures), and hundreds of billions more each year in collateral costs (police services, indigent defense, and lawsuits caused by aggressive policing). AOT programs reduce incarceration by over 85%.

For the last number of years, this writer has been continually censored while entering data online, and data has been tampered with and some removed that I posted. Incoming and outgoing emails have been monitored, and some were interrupted. Thanks to Edward Snowden's revelations, traitors cannot disclaim these allegations. People who read online articles by Mary Neal need not wait until more revelations are made by Edward Snowden's documents to realize the Internet is compromised. I gave up using Yahoo Mail years ago when most of my emails were bounced as I planned the "Human Rights for Prisoners March" in Atlanta in 2009. Our "Assistance to the Incarcerated Mentally Ill" group at Care2 is completely under stalkers' control. They covertly remove posts, prevent video posting, and prevent titles from being available to online search engines. Facebook is literally theirs.
