Terrell Scott's Torture Continues in Pennsylvania


Terrell Scott is pictured top, left in the collage above. Scott is a mentally ill black man who has been interned for over five years in Pennsylvania while denied his Sixth Amendment right to a trial. All the other mentally ill Americans in the photo were killed by law officers. Brian Claunch was a double amputee who was shot to death while sitting in his wheelchair in a Texas care home, "armed" with a ballpoint ink pen. Kelly Thomas was a homeless mentally ill man who was beaten to death by six Fullerton, California law officers. Larry Neal was secretly arrested (kidnapped) and interned in Memphis Shelby County Jail Scott for 18 days before being murdered on August 1, 2003, by undisclosed means. The government still refuses to reveal to his family how Larry was killed while police falsely, repeatedly denied having the disabled American in custody. Terrell Scott was incarcerated 4.5 years in torturous conditions before he finally agreed to sign a plea bargain after learning about two other mentally ill black men in Mississippi who had been illegally interned without trials nearly twice as long as he had been. 

Because this article is censored by terrorists and stalkers, it is repeated in three comments below. Please read them to ensure that you get the full understanding about Terrell Scott, a victimized mentally ill black man in America who deserves and needs help. Thank you.

Scott's own attorney, Phil Lauer, worked against Scott's right to a fair, public, speedy trial (see court documents proving this at Reference No. 1, below). Scott was released from the Pennsylvania prison for two months after signing the plea bargain, then the State rearrested him on new false charges. Scott's arrest occurred at a mental hospital where he was an inpatient, because Judge Zito said that "prison is the best place for mentally ill people like him." 

Scott was again denied any trial on the new charges the State levied against him. This time, Scott was denied even knowing what the new charges were. That is the "liberty and justice for all" that black men receive in the USA, especially those who are mentally ill. Black people with mental illness in the USA are treated like "useless life," except for prison profiteering. Prison profiteers earn more by incarcerating mentally ill people, and the U.S. Justice Department generally refuses to protect the rights of disabled Americans and institutionalized persons, especially African Americans. Below is an update by Terrell Scott's mother. Holly Alston wrote:

My forever tears for my son Free Terrell Scott again have taken over. My heart is so broken. My phone call with Terrell this past Monday was only about five minutes. Terrell sounded robotic, plus a staff member from Graterford State Prison was standing over him. But I received a letter from Terrell today which made me so upset.

Terrell has only been able to take two showers since he's been transferred to Graterford State Prison, he wasn't given any toiletries, he's lost over 20 lbs. They make him wear a "Turtle Suit," which is just a heavy green smock with Velcro tabs on it. The issue with this is that it's too small, and Terrell is getting yelled at because he can't keep it closed. Unfortunately, Terrell is being exposed practically nude. He has no privacy. The camera is on him 24 hours a day, and his cell is infested with mice and spiders.

Terrell wrote, "Mama, that's only the stuff I can tell you; if I told you everything . . . I wouldn't want you to have another heart attack."

I have no words. I can't stop crying knowing that my son continues to be tortured.

Excerpt: The American Civil Liberties Union, along with four newspapers, has filed a lawsuit against the state of Pennsylvania seeking to uncover the source of the drugs used in its lethal injection procedures. As Pennsylvania prepares to execute its first inmate in 15 years, the ACLU, the Guardian, the Philadelphia Inquirer, the Pittsburgh Post-Gazette, and the Philadelphia City Paper are arguing that the state’s refusal to reveal where it purchases its drugs is illegal. You can only save one: Terrell Scott

UPDATED June 27, 2014 and July 12, 2014

YOU CAN ONLY SAVE ONE OF THESE MENTALLY ILL AMERICANS. Only one of these men is still alive, and he is wrongfully incarcerated in Pennsylvania in grave danger: Terrell Scott (top left). Brian Claunch was killed by police who answered a call at his Texas care home. Claunch was a double amputee sitting in his wheelchair with a ballpoint ink pen as his only weapon. Police shot and killed the mentally, physically disabled man. Officers were not charged.

Kelly Thomas was killed by six Fullerton, California officers. He was an unarmed, homeless man who begged for his life while he was beaten by police into a coma. He died days later in the hospital. Two of the officers were charged and tried for murder but were not convicted.

Larry Neal was secretly arrested (kidnapped) and killed on the 18th day of secret incarceration in Memphis Shelby County Jail. Police repeatedly lied to Larry's family and social worker and denied having him in custody for almost three weeks while he was used for scientific experiments, water boarding training, or otherwise misused. The jail and the United States Department of Justice refuse to release records as to how and why Larry Neal was secretly arrested and murdered.

Terrell Scott was arrested and held without trial for 4.5 years in Pennsylvania. He was deemed too sick for trial but sane enough to plea bargain on false charges. Terrell was brutally beaten, raped, exposed to HIV virus, and subjected to inhumane solitary confinement until he agreed to sign the plea bargain. When he did, he was released on March 5, 2014. But he was re-arrested on June 5, 2014 on a new false charge and remains imprisoned now. Scott reported to his mother that Judge Zito signed an Order to incarcerate him for six months in the prison's drug/alcohol unit although Scott has never taken a drug test, never failed a drug test, and was never arrested in connection with drugs or alcohol. Scott was again denied a trial. Holly Alston called and spoke to a prison official over that detox floor and was told that Scott's placement there was an error that has now been corrected.

The mentally ill young man was arrested in June on false charges alleging probation violation. Scott was charged with missing two probation appointments that were scheduled for days before he was released from prison and one date while Scott was committed to a mental hospital. Scott was arrested at the mental hospital where he was undergoing treatment for post traumatic stress disorder (PTSD) resulting from his trauma while imprisoned 4.5 years without trial. Scott is so depressed to find himself back in prison, innocent of any crime, that he told his mother that he may not be able to make it this time.

Scott's probation violation hearing is scheduled for June 27.

June 27, 2014 UPDATE: Terrell Scott's hearing was postponed until Wednesday, July 2, 2014. His probation officer was reportedly unavailable for the hearing due to a family emergency. Scott was unable to be assigned a public defender. His treacherous former attorney, Glennis L Clark, Esq., who did not bother to show up for his client's first probation hearing, has refused to remove his name as the acting attorney. He was fired two weeks ago by Terrell's grandfather, who paid for his legal services. The family assumes Clark remains on record as legal counsel on this case simply to block Scott from having adequate representation.

July 12, 2014 UPDATE: Clark finally excused himself as Scott's attorney, and he was appointed a legal counsel. Alston reports that when she asked for Scott's legal file from Clark, his assistant said the file was not available because Clark was "not through removing documents from it." This was reportedly said before a witness and is obviously illegal. Scott had another hearing this week, and Judge Zito claimed there was nothing in Scott's file about his mental illness, which is astonishing. According to his mother, Pennsylvania planned to levy 40 new charges to excuse Scott's imprisonment - discovered by reading Scott's information online. Realizing that would necessitate a trial (which Scott has never had and is not expected to ever receive), Judge Zito allegedly claimed at the hearing that Scott must be imprisoned because he is mentally ill and suicidal. If that happens, Scott will be the first American we know about who was removed from a mental hospital and imprisoned for the "crime" of being mentally ill.

The U.S. Substance Abuse and Mental Health Services Administration (SAMHSA) is missing in action regarding its duty to protect persons with mental health disabilities from prison investors, with its $5.1 billion budget for 2014 (your tax money). The U.S. Department of Justice also abdicates its responsibilities to protect Americans with disabilities and allows prison investors to wrongly incarcerate 1.25 million mentally ill people in brutal and often deadly circumstances - IF they survive the lunacy arrests. Mentally ill Americans are routinely denied treatment to await crimes (including misdemeanors like vagrancy and panhandling) to excuse imprisonment. However, Terrell Scott may be the first citizen who was actually removed from a psychiatric facility in order to generate prison profits.

Crime Down; Imprisonment Up

Are jails and prisons kept full by withholding psychiatric drugs from acute mental patients so they will get extra time on their sentences after psychotic episodes? That appears to be happening in Fresno County Jail, according to a report by "Community Alliance - the voice of the progressive movement since 1996."

HOW are jails and prisons kept full? Crime is actually down. Christian Science Monitor reports: "Recessions can be the perfect storm for crime. Yet preliminary crime figures from the Federal Bureau of Investigation for 2009 show that the crime rate is falling across America, across all categories. Violent crime was down 5.5 percent and property crime down 4.9 percent between 2008 and 2009, according to FBI statistics . . . Crime in every category decreased, says FBI spokesman Bill Carter. Murder, forcible rape, robbery, and aggravated assault all declined in 2009, he said. Robbery – which tends to boom in bust times – dropped 8.1 percent."

Freefall into Madness: The Fresno County Jail’s Barbaric Treatment of the Mentally Ill

For the past six years, in an effort to cut costs, the Fresno County Jail has repeatedly denied mentally ill defendants the anti-psychotic medications prescribed to them by their outside doctors—medications needed to keep them sane.

As a result, according to Fresno County judges, former nurses, correctional officers, doctors, lawyers and the families of the defendants, the jail medical staff is triggering psychotic breakdowns in people suffering from bipolar disorder and schizophrenia.

The prolonged mental breakdowns are causing some defendants to languish in isolated confinement for years at a time, they say, creating a system of mental torture at the county jail. Denied their usual medications, defendants suffer paranoid delusions and mania so debilitating that some have tried to commit suicide multiple times in jail, slashing their throats or wrists with county-issued razors.

According to DOJ’s Bureau of Justice Statistics, U.S. gun-related homicides dropped 39 percent over the course of 18 years, from 18,253 during 1993, to 11,101 in 2011. During the same period, non-fatal firearm crimes decreased even more, a whopping 69 percent . . . Pew researchers observed that the huge amount of attention devoted to gun violence incidents in the media has caused most Americans to be unaware that gun crime is “strikingly down” from 20 years ago. In fact, gun-related homicides in the late 2000s were “equal to those not seen since the early 1960s.”

Americans are continually plummeted with violent scenes on the evening news, but little to nothing is reported about the nation's falling crime rate. Whereas the reduction in crime is good news for the average citizen, it is not good news for prison investors or for municipalities that signed contracts with private prison companies, guaranteeing them a certain occupancy rate. Therefore, I repeat the question in paragraph 1:

~ The members and friends of Assistance to the Incarcerated Mentally Ill strongly object to withholding psychiatric drugs to induce lunacy in order to lengthen sentences of wrongly imprisoned mental patients, who should be either in mental hospitals or community care programs. 

~ We object to crime and punishment becoming an business enterprise that reduces people to commodities that are bought and sold on Wall Street. 

~ We object to privatized correctional institutions and feel the quest for success of such facilities led to mass incarceration for Americans, regardless of their innocence or mental illness. 

~ We submit to you that the War on Drugs is actually a war on middle-class and indigent Americans who are either recreational drug users or addicted to hard drugs. 

We urge everyone who is committed to prison reform to recognize this: There were no overcrowded prisons and jails and therefore no need for private correctional facilities until the mentally ill were "de-institutionalized" and evicted from mental hospitals and community psychiatric services suffered budget cuts. Mentally ill people in America are the backbone of the private prison industry, which grosses billions per year. Crime is declining, including violent crime, which generates the longest prison sentences. With the loss of "business," the mentally ill are at greater risk than ever of suffering long prison sentences to satisfy the greed of prison investors, who include judges, defense attorneys, prosecutors, and lawmakers.

America's reduction in violent crime has not generated the cheers one would expect, because it could mean less money for prison owners and investors. This places targeted populations (minorities, the mentally ill, and whites who lack wealth) at greater risk for excessive sentencing and wrongful convictions. Three examples happened recently in Florida and Louisiana: 


~Marissa Alexander is a Florida woman who had just given birth and feared serious injuries from being beaten by her ex-husband, who caused her to be hospitalized from a previous beating. As he cornered and threatened her, Alexander fired a warning shot. She was wrongly sentenced to 20 years imprisonment for firing one shot into the ceiling. ~Sharmeka Moffitt,woman in Louisiana, allegedly set fire to herself, causing third degree burns, and falsely claimed she was set afire by a white supremacist group. Obviously, if Moffitt did this, one should question her mental state. Instead, she faces "terrorism" charges and could be imprisoned for decades for hurting herself. ~Kiera Wilmot, a teenage Florida girl, was expelled and faced felony charges for her science experiment when her mixture of common household products caused the top to pop off a water bottle. Nobody was hurt. Due to an outcry by people nationwide and a successful Change.org petition that gathered nearly 200,000 signatures, the charges were dropped. Both women and the teen are black females, which matters more than it should in this land of "liberty and justice for all."

How far will prison owners and investors go with their "quest to arrest"? For the first time in centuries, debtors prisons are making a comeback. For the first time in America, the White House has the option under NDAA to point out any person or group of people and demand their arrest in military concentration camps without naming any crime or allowing trials. The love of money led to slavery in the 1600s, an institution that has made a comeback in America. This is particularly hard on those who through poverty or mental illness are our most vulnerable citizens.



“This county [Fresno] doesn’t care about its treatment of mentally ill behind bars or otherwise,” said Susan Anderson, the recently retired supervisor who watched her colleagues on the board implement cut after cut to the county’s mental health budget until, she said, there was nothing left but skin and bones.

“If the Board of Supervisors wanted mentally ill defendants to get their anti-psychotic medications in jail, all they would need to do is direct the sheriff, the health officer and the jail doctor to do it,” Anderson said. “But the thinking of the board, the sheriff’s [office] and the rest of the criminal justice system here is not about prevention or humanity. It’s all about punishment.”
